TERMS OF SERVICE

This agreement governs your use of the software application Open Foris Ground (“Application”) published by the Open Foris Initiative. 

By using Open Foris Ground, you acknowledge that you have read, understood, and agree to be bound by the following terms of service and any future modifications to this agreement.

Collection of Information

The Application obtains the information you provide (“Your Data”) when you use it (location, photos, thematic answers) and the user always triggers the collection of this information. This Application collects precise information about the location of your mobile device only when you (the User) trigger the collection of this information (i.e., within location-based data collection tasks).

Use of Data  by the Application

Data collected via the application will be accessible to and managed by the creator of each respective survey.

Opt-out Options

You can stop all collection of information by the Application by signing out of the Application.

Data Retention Policy, Managing your Information

We will retain Your Data for as long as you use the Application and for a reasonable time after that.

Changes to the Terms of Service

The Terms of Service may be updated from time to time for any reason. We will notify you of any changes to our Terms of Service by posting the new version here.

Liability

The Food and Agriculture Organization of the United Nations shall not be liable for any losses, damages or expenses arising from any intentional or negligent misuse, error, disclosure, loss or destruction of data that may occur. In no event shall FAO be liable for any indirect, incidental or consequential damages arising out of the use of, or inability to use Ground/Ground web console.

In using this service, you understand the service allows you to share your data with others and acknowledge that Ground will not be responsible for how your data is used by others if you share it or make it public.

Disclaimers and Limitations of Liability

We disclaim all responsibility and liability for the availability, timeliness, security or reliability of Open Foris Ground. THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHERWISE. WITHOUT LIMITATION, WE DISCLAIM ANY AND ALL WARRANTIES REGARDING THE ACCURACY, SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF ALL SERVICES ASSOCIATED WITH USE OF THE SITE AND THE SERVICES. WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, THAT YOUR USE OF THE SITE AND THE SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE. We will not be responsible for any harm to your computer, mobile phone or tablet, loss of data or other harm that results from your use of Ground.

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF OR INABILITY TO USE THE SITE OR THE SERVICES. YOU EXPRESSLY AGREE THAT YOUR USE OF GROUND IS SOLELY AT YOUR OWN RISK. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INCOME, BUSINESS OPPORTUNITIES, AND ANY OTHER INJURY REGARDLESS OF THE NATURE OF THE CLAIM OR THE FORM OF ACTION, ARISING OUT OF OR CONNECTED WITH THE SITE (INCLUDING BUT NOT LIMITED TO ITS OPERATION, ITS CONTENTS, OR THE INFORMATION OR MATERIALS CONTAINED THEREIN, OR THE USE OR INABILITY TO USE THE SERVICES OR ANY OTHER SITE LINKED TO THE SITE, OR ANY CONTENT CONTAINED IN ANY SUCH SITE) EVEN IF WE, OR OUR SUPPLIERS OR LICENSORS HAVE BEEN NOTIFIED OF THE POSSIBILITY OF ANY DAMAGES

As a condition of your use of the Services, you warrant that you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, or notices. You may not use the Services in any manner which could damage, disable, overburden, or impair the Services. 

You are responsible for maintaining the security of your account and password. You are solely responsible for all your account activity when using this service. You acknowledge and agree that you are responsible for ensuring that your use of this service complies with all relevant local and international laws.
